The British Plastics Federation (BPF) surveyed its members to learn exactly how the coronavirus pandemic is affecting the plastics industry within the UK and published the results on 20 March 2020.

The government is asking businesses to get in touch directly if they are able to help with the national response to the coronavirus – from warehouse space, to PPE and manufacturing equipment.

Allocation of coronavirus testing

The Department of Health and Social Care has published a policy paper on the government's allocation of testing for coronavirus in England. The proposed priority for testing runs from 1) NHS clinical care to 6) The general public and does not currently include key workers across the supply chain.

North of England local restrictions:

An outbreak of coronavirus (COVID-19) has been identified in parts of Greater Manchester, East Lancashire, Preston, and West Yorkshire. The UK government and relevant local authorities are acting together to control the spread of the virus. To find out more click here.

New modelling on second Covid-19 wave

The Academy of Medical Sciences (AMS) was asked by the Government's Chief Scientific Advisor Sir Patrick Vallance to assess the different risks the NHS faces this winter and they have now published their report which suggests cases will significantly increase in a second Covid-19 wave this winter.

Two billion items of PPE delivered to frontline workers

The government has announced that two billion items of PPE have been delivered to NHS and social care staff across the UK since the start of the COVID-19 outbreak. 341 million masks, 313 million aprons, 4 million gowns and 1.1 billion gloves have been delivered.

HSE Safety Alert issued: Use of face masks designated KN95

The Health and Safety Executive have warned that a substantial number of face masks, claiming to be of a KN95 standard, provide an inadequate level of protection and are likely to be poor quality products accompanied by fake or fraudulent paperwork. These face masks may also be known as filtering facepiece respirators.

Face coverings to become mandatory on public transport

The government has announced that from 15 June, face coverings will be required while using public transport in England.

First aid cover and qualifications during the outbreak

The Health and Safety Executive have issued guidance for businesses on first aid cover and qualifications to ensure they still comply with the law – in the event their first aid cover is reduced because of coronavirus.

PPE Disposal – raising awareness of the correct disposal route

The BPF have been working with Keep Britain Tidy, WRAP and Recoup on using social media to promote the correct disposal route for PPE. As members will know, PPE can’t be recycled as it is a potential health concern, so it needs to go in the general waste bins. We would like to encourage members to help raise awareness of this on social media using this artwork.

UK reaches 200,000 coronavirus testing capacity

Following the rapid expansion of coronavirus testing, the UK has now reached the 200,000 capacity target, including capacity for 40,000 antibody tests a day.

BPF member praised in House of Lords Debate on business addressing the coronavirus

BPF member Industrial Textiles & Plastics were praised in a debate in the House of Lords yesterday by Baroness McIntosh of Pickering, for joining forces with Barbour and Burberry to manufacture personal protective equipment, free of charge. The PPE is distributed by a local voluntary organisation for use by local hospitals.

Virtual Parliament to end on 2 June

Jacob Rees Mogg has told the Commons that he will end virtual proceedings when MPs return from recess on 2 June. However, MPs staff will be encouraged to work from home and it is unlikely that visitors will be allowed into Parliament for some time.

Everyone in the United Kingdom with symptoms now eligible for coronavirus tests

The government has announced that anyone with symptoms of coronavirus is now eligible to book a test, ahead of the rollout of the test and trace service.  The expansion in testing eligibility comes after all 4 UK Chief Medical Officers confirmed that anosmia has been added as a symptom of COVID-19. Anosmia is the loss of or a change in your normal sense of smell, and it can also affect your sense of taste.

Government to procure antibody tests

13 May

Government officials are in negotiations with Swiss health care firm Roche today to procure millions of coronavirus antibody tests, after Public Health England approved a kit at Porton Down last week. This is the test that can confirm whether a person has previously had the virus, which was hailed as a “game-changer” by the Prime Minister and is seen as a route out of lockdown, assuming those who have had the disease are immune.

Ventilator/Oxygen Tubing Anchor Opportunity

Edinburgh Napier University is seeking potential licensees for a “Tubing Anchor device” that firmly grips Ventilator oxygen tubing to reduce/avoid pulling/snagging or tugging which can cause friction or more critically, detachment or displacement of an endotracheal or tracheostomy tube in ventilated or respiratory assisted patients. There is a patent pending, the device can be 3D printed/mass-manufactured and could offer a "a value added" product to ventilator, respirator or CPAP breathing circuit manufacturer. Home testing programme for coronavirus to track levels of infection in the community

The government has announced a new programme of home testing for coronavirus to track the progress of the infection across England. 100,000 randomly selected people from across England will be invited to provide nose and throat swabs, which will be tested for antigens indicating the presence of the virus.

Further expansion of access to coronavirus testing

The government has announced that anyone in England with coronavirus symptoms who either has to leave home to go to work or is aged 65 and over will now be able to get tested.

Update on the Ventilator Challenge

The government has announced it will continue to support eleven devices in its Ventilator Challenge, as part of the drive to increase ventilator supply and protect the NHS.

Italy and Spain announce plans to ease lockdown

28 April

Italy and Spain, two of the European countries with the strictest coronavirus lockdowns, yesterday announced plans to ease restrictions. The measures include the reopening of Italy's manufacturing industry on May 4.

Government pledges support for freight services to protect flow of goods

28 April

The government have announced a multimillion coronavirus support package for essential freight services to keep the flow of goods and services running smoothly in and out of the UK, and around the country, throughout the pandemic. In the 24th April government press briefing the Transport Secretary paid tribute to transport workers who have kept vital freight services open.

Essential worker testing - update

28 April

Essential workers can now book tests for themselves and their household via a new online portal on gov.uk with more allocations being released on a daily basis. The government have also updated their guidance on testing for essential workers and announced the creation of mobile testing units, operated by the Armed Forces, which will travel around the UK to increase access to testing.  Further information for employers on testing can be found in the attached letter from the Secretary of State for Health and Social Care.

New advice on face masks expected today

24 April

The government's scientific advisers will present their findings to ministers later today on whether the public should wear face masks. They are expected to indicate that the public should not wear medical face masks but should feel free to cover their faces with scarves or home-made masks.

Updates from the European Commission

14 April

The European Commission has issued guidance asking Member States to end export restrictions or bans on medical products necessary to fight the virus. Last week, it also published a Temporary Framework Communication to provide antitrust guidance to companies cooperating in response to the COVID-19 outbreak.

The Commission has proposed to Member States that they amend the State-aid Temporary Framework currently in place, to allow for greater Member State flexibility providing recapitalisation to companies in need.

The government's 5-pillar plan

At yesterday’s Downing Street press conference the Secretary of State for Health outlined a 5-pillar plan to increase testing to 100,000 a day in England.

Network Rail call for assistance in providing PPE

Social distancing measures and appropriate PPE are needed to allow Network Rail and supplier staff to continue working to maintain essential rail services during the Coronavirus Pandemic. It is becoming increasingly difficult to secure PPE such as Face Masks and, quite rightly, the NHS is being prioritised. Therefore Network Rail is urgently challenging the industry to propose innovative ways to increase the supply of face masks for situations where they are required to by task-specific risk assessments.

It is envisaged that the prime focus will be on:

1. Equivalents to the EN14683 type 1 surgical mask

2. Visors which could be worn with safety helmets

3. Equivalents to respirator type masks would also be welcome

4. Solutions which can be reused/ filters replaced would be particularly welcome.

MP’s approve second lockdown

MPs this week voted in favour of the four-week national lockdown in England. Ahead of the vote, Boris Johnson gave a statement in Parliament explaining why he believes a lockdown is necessary.

BPF responds to the government’s PPE Strategy

The BPF have responded to the government’s PPE Strategy which sets out preparations for a second wave of Covid-19. The Department for Health and Social Care intends to start transitioning to a new PPE procurement model next year and the BPF has urged the government to start in-depth consultation with industry on this as soon as possible. PPE manufacturers need a clear understanding of expected demand going forward so that the right investments can be made in time and so that businesses are not inadvertently harmed when they are playing a vital role in helping the country to function safely.

 

Three-tier coronavirus lockdown system

The Prime Minister has announced a new three-tier coronavirus lockdown system, in which areas in England will be labelled as "medium", "high" or "very high" risk.   The PM said the alert system for England could succeed in driving cases down if it was implemented "very effectively", and he rejected the "extreme route" of a full nationwide lockdown "right now".  Shortly after the press conference, minutes from the meeting of the Scientific Advisory Group for Emergencies (Sage) stated the advisers had called for the immediate introduction of a short national lockdown three weeks ago.

 

Deputy Chief Medical Officer Professor Jonathan Van-Tam's view on Covid-19

The Deputy Chief Medical Officer has outlined his view on the current Covid-19 situation in an opinion piece on the Department of Health website and at a Downing Street press conference. He has warned that the UK is at a tipping point similar to where we were in March but suggested that we can prevent history repeating itself if we all act now.

 

Covid-19 and surface transmission

In an interview with US science website Nautilus, Monica Gandhi, a professor of medicine at the University of California, San Francisco, and associate division chief of the Division of HIV, Infectious Diseases, and Global Medicine said that “we now know the root of the spread is not from touching surfaces and touching your eye. It’s from being close to someone spewing virus from their nose and mouth, without in most cases knowing they are doing so”. When asked about the easiest way to catch the virus she added, “It’s not through surfaces”.

New government package to support and enforce self-isolation

The government have announced that people will be required by law to self-isolate from 28 September, supported by a payment of £500 for those on lower incomes who cannot work from home and have lost income as a result. New fines for those breaching self-isolation rules will start at £1,000 – bringing this in line with the penalty for breaking quarantine after international travel - but could increase to up to £10,000 for repeat offences and for the most egregious breaches, including for those preventing others from self-isolating. 

New Covid restrictions could last six months

The Prime Minister has set out new coronavirus restrictions and doubled the penalty of not wearing masks or breaking the rule of six to £200 for the first offence. The new restrictions include office workers being told to stay at home if they can, although the Prime Minister stressed that where this is not possible people should continue to attend workplaces.

COVID-19 alert level increases

The Chief Medical Officers for England, Scotland, Wales and Northern Ireland have recommended all 4 nations of the UK should move from level 3 (COVID-19 epidemic is in general circulation) to level 4 (COVID-19 epidemic is in general circulation, transmission is high or rising exponentially).

New COVID-19 local restrictions

From Friday 18 September new restrictions have been introduced in parts of the north-east of England – in Durham; Gateshead; Newcastle; Northumberland; North Tyneside; South Tyneside; and Sunderland – to curb rising infection rates.

From Tuesday 22 September, new restrictions have been introduced  in the North west – in Merseyside; Warrington; Halton; and Lancashire (excluding Blackpool and Greater Manchester).

PM statement on COVID-19

On Friday, the Prime Minister set out plans for moving to the next phase of the UK Government’s response to the virus. He also made it clear that anybody in England may use public transport, although people should consider alternative options where they are available.

Face coverings to be mandatory in shops from 24th July

Wearing a face covering will be compulsory in England’s shops and supermarkets from July 24 and those that do not cover up will face £100 fines.  There are no plans to make face coverings mandatory for office workers in England.

PM announces easing of lockdown restrictions – and changes to the two-meter rule

On Tuesday, the Prime Minister announced further easements of the coronavirus restrictions as part of Step Three of the government’s plan to return life to as near normal as possible.  Following a review, the Prime Minister also set out that where it is not possible to stay two metres apart, guidance will allow people to keep a social distance of ‘one metre plus’. This means staying one metre apart, plus mitigations which reduce the risk of transmission.

The government has confirmed that the 2 metre distancing rule remains under review in England.

Update on UK quarantine exemptions

The government have now made it clear that almost all exemptions from the UK quarantine plans will now be required to complete the public health passenger locator form before travelling to the UK. Details of those who are exempt from quarantine – including workers with specialist technical skills - can be found here.

Government coronavirus guidance – the role of perspex screens

The Government have updated their guidance for people who have been notified by NHS Test and Trace that they are a contact of a person who has had a positive test result for COVID-19. This guidance makes clear that “Where an interaction between 2 people has taken place through a Perspex (or equivalent) screen, this would not be considered sufficient contact, provided that there has been no other contact such as any of those indicated” on the government advice page.

PM to announce findings of Government review into two-metre social distancing rule

Boris Johnson will announce the findings of the Government review into the two-metre coronavirus social distancing rule on Tuesday in the House of Commons.

No two-metre rule lifting until at least July 4, the Prime Minister suggests

The Prime Minister has suggested that there will be no lifting of the two-metre social distancing rule before July 4.   The Prime Minister has ordered a review of the current guidance, but speaking to reporters on Sunday he said that the rule would be kept “under review for 4 July”, a date which marks the next phase of the Government’s “road map” for easing lockdown measures.

Government accelerates border planning for the end of the Transition Period

Border controls for EU goods imported into Great Britain will be introduced at the end of Transition Period in stages to give businesses affected by coronavirus more time to prepare. The Chancellor of the Duchy of Lancaster Michael Gove has also confirmed the UK will not agree or request an extension to the Brexit transition period.

Treasury Select Committee call for more government support

The Treasury Select Committee have published their report into the economic impact of coronavirus – ‘Gaps in support’. The committee is urging the government to help over a million people who have lost livelihoods while being locked down and locked out of support.

Government coronavirus guidance – the role of perspex screens

The Government have updated their guidance for people who have been notified by NHS Test and Trace that they are a contact of a person who has had a positive test result for COVID-19. This guidance makes clear that “Where an interaction between 2 people has taken place through a Perspex (or equivalent) screen, this would not be considered sufficient contact, provided that there has been no other contact such as any of those indicated” on the government advice page.

As members will know, PPE can’t be recycled as it is a potential health concern, so it needs to go in the general waste bins. UK air bridges

In the Q&A section of yesterday’s daily press conference, Boris Johnson confirmed that the government will “certainly be developing” air bridges to exempt travellers to countries with low or similar levels of infection from having to quarantine on their return to the U.K. The Home Secretary has however made it clear that air bridges won’t arrive until at least the first review of the new rules, scheduled for the week commencing June 28.

Ministers 'looking at ways to relax travel quarantine rule'

It has been reported that the government is looking at ways to relax the 14-day quarantine rule for people entering the UK over the coming months.

Temporary relaxation of the enforcement of the driver’s hours rules: all sectors carriage of goods by road

Following a recent review, the government has decided not to extend the relaxation of the EU drivers’ hours rules; which ended at 23:59 on Sunday 31 May 2020. The relaxation of the GB domestic drivers’ hours rules will continue until 23:59 on Sunday 14 June 2020.

NHS Track and Trace – Government Information

The government has published guidance on the test and trace service which can be viewed here. It notes that “anyone who tests positive for coronavirus will be contacted by NHS Test and Trace and will need to share information about their recent interactions. This could include household members, people with whom they have been in direct contact, or within 2 metres for more than 15 minutes”.

Scotland has begun to ease its lockdown with new rules allowing people from two households to meet outside so long as they keep at least two metres apart.

Government launches NHS Test and Trace service

From today, anyone who tests positive for coronavirus will be contacted by NHS Test and Trace and will need to share information about their recent interactions. This could include household members, people with whom they have been in direct contact, or within 2 metres for more than 15 minutes. People identified as having been in close contact with someone who has a positive test must stay at home for 14 days, even if they do not have symptoms, to stop unknowingly spreading the virus.  The government have published guidance on the test and trace service for employers, businesses and workers.

Coronavirus: Local lockdowns will be used to suppress 'flare-ups'

The Health Secretary has said that "Local lockdowns" will be introduced to tackle regional outbreaks of coronavirus in England in the future.  Matt Hancock suggested restrictions will be introduced in areas with "flare-ups", but not others, as part of a system being put in place.

The government has signed deals with more than 100 new suppliers from around the world as well as ramping up domestic production to help meet demand for PPE.

New UK border measures – Essential Worker exemption

The government have announced new measures at the UK border to guard against a second wave of coronavirus infections – these measures come into force on 8 June. Scottish Government’s Lockdown Roadmap

First Minister Nicola Sturgeon has confirmed details of the Scottish Government’s Lockdown, with restrictions in Scotland likely to be relaxed slightly from 28 May.

Announcements include:

  • The first phase will include allowing people to meet outside with people from one other household.
  • Garden centres and recycling facilities will reopen, and outdoor activities such as golf, fishing, tennis and bowls will be allowed again.
  • The situation will be reviewed every three weeks, with further phases of easing being introduced if enough progress is being made on keeping the virus under control.

Coronavirus Job Retention Scheme

A reminder that businesses need to apply for this Scheme by 20 May to ensure they receive a payment by the end of May.  From 1 August to the end of October, HMRC will introduce more flexibility so employers will be able to bring their furloughed employees back to work part-time and contribute to paying employees' wages while still receiving support from the scheme.

Coronavirus Statutory Sick Pay Rebate Scheme set to launch

The government has announced the launch of a new online service on 26 May for small and medium-sized employers to recover Statutory Sick Pay payments they have made to their employees. This scheme will allow small and medium-sized employers, with fewer than 250 employees, to apply to HMRC to recover the costs of paying coronavirus-related SSP.

Larger businesses to benefit from loans of up to £200 million

19 May

Businesses will be able to benefit from larger loans under the Coronavirus Large Business Interruption Loan Scheme, the government has announced.  The maximum loan size available under the scheme will be increased from £50 million to £200 million to help ensure those large firms which do not qualify for the Bank of England’s COVID Corporate Financing Facility have enough finance to meet cashflow needs during the outbreak.

Government invests £35 million to protect critical freight routes

The government has signed agreements with 6 operators to provide up to £35 million to help ensure there is enough freight capacity to prevent disruption to the flow of goods.  The decision has been made to protect 16 of the most important routes covering the Channel, the Short Strait, the North Sea and routes between Great Britain and Northern Ireland which were previously at risk of closure due to a drop in demand as a result of coronavirus.

UK Global Tariff backs UK businesses and consumers

The government has announced the UK’s new MFN tariff regime, the UK Global Tariff. This will replace the EU’s Common External Tariff on 1 January 2021 at the end of the Transition Period.  The UKGT will apply to all goods imported into the UK from Most Favoured Nation countries from 11pm on 31 December 2020, unless an exception applies. The UKGT will not apply to goods coming from developing countries that benefit under a specific scheme, for example the Generalised System of Preferences, or to goods originating from countries with which the UK has negotiated a Free Trade Agreement. It will not alter the protection in place from trade remedies which are being transitioned to the UK system.

Government begins large scale study of coronavirus immunity

Up to 20,000 people are being asked to take part in a new government-funded study to further track the extent of the coronavirus spread across England, Scotland and Wales.  The research will measure blood antibodies to help determine what proportion of the population has already had the infection, the duration of immunity after being infected, and why the virus affects people differently.

The Government’s COVID-19 recovery strategy – changes to lockdown

The Prime Minister yesterday gave a statement in the House of Commons on the changes the Government have made to the lockdown and their approach going forward and he led the daily media briefing. Yesterday also saw the Government publish their COVID-19 recovery strategy which  includes the following important points:

  • Working arrangements: For the foreseeable future, workers should continue to work from home rather than their normal physical workplace, wherever possible.  All workers who cannot work from home should travel to work if their workplace is open. Sectors of the economy that are allowed to be open should be open, for example this includes food production, construction, manufacturing, logistics, distribution and scientific research in laboratories.
  • Travel: When travelling everybody (including critical workers) should continue to avoid public transport wherever possible.
  • Face-coverings: The Government is now advising that people should aim to wear a face-covering in enclosed spaces where social distancing is not always possible and they come into contact with others that they do not normally meet, for example on public transport or in some shops. Homemade cloth face-coverings can help reduce the risk of transmission in some circumstances. Face-coverings are not intended to help the wearer, but to protect against inadvertent transmission of the disease to others if you have it asymptomatically. They do not need to be worn outdoors, while exercising, in schools, in workplaces such as offices, and retail, or by those who may find them difficult to wear.

Working safely during COVID-19

The government, in consultation with industry, has released ‘COVID-19 secure’ guidance to help ensure workplaces are as safe as possible. The guide includes specific guidance for eight workplace settings including: factories, plants and warehouses, construction and other outdoor work and offices and contact centres.

All the guidance sets out practical steps for businesses focused on 5 key points:

1.           Work from home, if you can

2.           Carry out a COVID-19 risk assessment, in consultation with workers or trade unions

3.           Maintain 2 metres social distancing, wherever possible

PM announces changes to lockdown

The Prime Minister last night gave a pre-recorded televised address on coronavirus. In the address he said, “We now need to stress that anyone who can’t work from home, for instance those in construction or manufacturing, should be actively encouraged to go to work”. 

  • The Prime Minister unveiled a new lockdown ranking scale – from level 1 to 5, with 1 meaning that the virus is no longer present in the UK and 5 that the threat is critical. The Prime Minister said that over the period of the lockdown England has been in Level Four, and it is now beginning to move into Level Three.
  • The “Stay Home” slogan has been replaced with “Stay Alert to control the virus and save lives”.
  • The Prime Minister said that those who can work from home, should continue to do so - however, if you cannot work from home then you are now actively encouraged to return to work. The Prime Minister indicated this was effective from this morning, however Foreign Secretary Dominic Raab stated on BBCR4 Today that this would not be effective until Wednesday 13th May.

Essential worker testing - update

Coronavirus Job Retention Scheme – new guidance

The government has issued further guidance on the Coronavirus Job Retention Scheme which changes the cut-off date for the Scheme from 28 February 2020 to 19 March 2020.

The Chancellor has also published a direction to HMRC that sets out the legal framework for the scheme and clarifies when an employee will be regarded as "furloughed".

The key changes from the revised guidance are that:

  • All employers with a PAYE payroll as at 19 March 2020 are now eligible for the scheme (previously employers had to have a UK payroll on or before 28 February 2020 to be eligible).
  • Employers can now claim for employees that were on the PAYE payroll as at 19 March 2020 (previously employees had to be on the payroll on 28 February 2020 to be covered).
  • For salaried employees, the salary as at 19 March 2020 (instead of 28 February 2020) should now be used to calculate claims under the Scheme (but employers who have used 28 February 2020 based on previous guidance can continue to use this calculation for the first claim under the scheme).
  • Employees who have been inherited on a TUPE transfer after 19 March 2020 may be furloughed, and the employer can claim under the scheme in respect of these employees (even if the new employer did not operate payroll on 19 March 2020).

In addition, the Chancellor's direction to HMRC confirms that:

  • Furloughed employees do not need to be at risk of redundancy to qualify under the scheme but the reason for the furlough must be connected to the coronavirus.
  • To qualify as furloughed, there must be an agreement in writing between the employer and employee that the employee will cease all work in relation to their employment – email will suffice for these purposes. This requirement is new and employers who have relied on implied or deemed consent to the furlough may now wish to consider obtaining confirmation from furloughed employees of their agreement to the furlough, as the reference to "agreement in writing" suggests express consent may be a requirement.

There has been no announcement yet on whether the scheme will be extended beyond the initial three-month period ending on 31 May 2020.

Self-employment Income Support Scheme

The government has announced the Self-employment Income Support Scheme (SEISS) to support self-employed individuals (including members of partnerships) whose income has been negatively impacted by COVID-19. EU wide ventilator procurement scheme

The government admitted yesterday it had not taken up an invitation to join the EU-wide procurement for the life-saving equipment and blamed an email mix-up for the UK’s lack of participation. A European Commission spokesperson said the U.K. had always remained able to participate in the EU’s joint procurement efforts.

Government advice for food businesses on COVID-19

27 March

The government’s latest advice for food businesses on the coronavirus (published 25 March) includes a paragraph referencing the World Health Organization, which makes it clear that the likelihood of an infected person contaminating commercial goods is low. The risk of catching the virus that causes COVID-19 from a package that has been moved, travelled, and exposed to different conditions and temperature is also very low.

In an open letter to the Food and Drink industry yesterday, the Environment Secretary also said: “The advice of Public Health England is that there is very little risk of the virus being spread on food or packaging.”

Coronavirus information service on WhatsApp

The government has launched a Coronavirus Information service on WhatsApp. The free-to-use service aims to provide official, trustworthy information about the coronavirus and aims to reduce the burden on NHS services. Add 07860 064422 into your phone contacts and then message the word ‘hi’ to access the service.

Visa Extensions

26 March

The government has announced visa extensions until 31 May for all foreign nationals in the UK and a dedicated COVID-19 immigration team has been set up to make the process as straightforward as possible. Individuals who are in the UK and whose visa expired after 24 January are being urged to contact the Home Office on [email protected], and they will be issued an extension until 31 May. This timeline will be kept under review in case a further extension is needed. 

Profiteering

26 March

Boris Johnson also announced in yesterday afternoon’s press conference that he didn’t want to see businesses or individuals “profiteering” from the situation and, according to the Guardian, is considering introducing “wartime-style” legislation to make it illegal. 
 
 

Business closures

26 March

Guidance on the closure of all retailers that sell non-essential goods and other non-essential premises has been updated to include additional details to the list of businesses and premises that must remain closed. This still does not mention anything about construction, manufacturers or their supply chains, although further updates are of course possible.

25 March

The government has made an important clarification that ‘it is important for business to carry on’. As set out in its latest guidance:

 “...people can travel to and from work, but only where the work they do absolutely cannot be done from home. 

With the exception of the organisations covered above in the section on closing non-essential shops and public spaces, the government has not required any other businesses to close – indeed it is important for business to carry on.”

Retail closures

24 March

Following the government's advice for people to stay at home wherever possible and for non-essential retailers and premises to close, it also announced the following retailers can remain open: supermarkets and other food shops, health shops, pharmacies including non-dispensing pharmacies, petrol stations, bicycle shops, home and hardware shops, laundrettes and dry cleaners, garages, car rentals, pet shops, corner shops, newsagents, post offices, and banks.

Online retail is still open and encouraged and postal and delivery service will run as normal.

The Ministry of Housing, Communities and Local Government  published guidance on further businesses and premises that would close following the Prime Ministers announcement.  The list of businesses that must close include a range of retail outlets including clothing and electronic stores, libraries and places of worship. The Bill passed through the Commons without a vote yesterday and will now proceed to the Lords.  

The government will review these measures in three weeks, and relax them if the evidence shows this is possible.

The Medicines and Healthcare products Regulatory Agency (MHRA) has also produced guidance for industry covering the Coronavirus (COVID-19) outbreak.

Three-month extension period to file accounts

26 March

Businesses will be given an additional three months to file accounts with Companies House to help companies avoid penalties as they deal with the impact of COVID-19.

Commercial insurance

26 March

Government guidance states that most commercial insurance policies are unlikely to cover pandemics or unspecified notifiable diseases, such as COVID-19. However, those businesses which have an insurance policy that covers government ordered closure and pandemics or government ordered closure and unspecified notifiable disease should be able to make a claim. Insurance policies differ significantly, so businesses are encouraged to check the terms and conditions of their specific policy and contact their providers. 

Protection from eviction for commercial tenants

26 March

Commercial tenants who cannot pay their rent because of COVID-19 will be protected from eviction. A few further details are now available.

DIT support for UK businesses trading internationally

EU Green Lanes

Extension of Business Improvement Districts (BIDs) arrangements

BIDs will be able to extend the maximum duration of their BID arrangements until 31 March 2021 by delaying BID ballots due to take place this year. The measures apply to any BID in England due to ballot between now and 31 December 2020.

Competition Law

The government has announced that they are temporarily relaxing elements of competition law as part of a package of measures to allow supermarkets to work together to feed the nation.
 
The move allows retailers to share data with each other on stock levels, cooperate to keep shops open, or share distribution depots and delivery vans. It would also allow retailers to pool staff with one another to help meet demand.
 
The government has also temporarily relaxed rules around drivers’ hours, so retailers can deliver more food to stores, and is waiving the 5p plastic bag charge for online purchases to speed up deliveries.

Critical Workers

25 March

Earlier government announcements regarding ‘critical’ or ‘key’ workers related to whether employees should send their children to school, college or other childcare providers. If any of your staff are deemed ‘critical’ or ‘key’ workers, there is no register or form to fill out. Instead, employers are advised to draft a ‘To Whom It May Concern’ letter for eligible employees with children to take to their school or local authority, as explained below.

Parents whose work is critical to the COVID-19 response have been outlined by the government, although exact details remain unclear at this point in time: 
 
  1. Health and social care - This includes but is not limited to those working as part of the health and social care supply chain, including producers and distributers of medicines and medical and personal protective equipment.
  2. Education and childcare 
  3. Key public services 
  4. Local and national government 
  5. Food and other necessary goods - This includes those involved in food production, processing, distribution, sale and delivery, as well as those essential to the provision of other key goods (for example hygienic and veterinary medicines).
  6. Public safety and national security
  7. Transport - This includes those who will keep the air, water, road and rail passenger and freight transport modes operating during the COVID-19 response, including those working on transport systems through which supply chains pass.
  8. Utilities, communication and financial services - This includes staff needed for essential financial services provision (including but not limited to workers in banks, building societies and financial market infrastructure), the oil, gas, electricity and water sectors (including sewerage), information technology and data infrastructure sector and primary industry supplies to continue during the COVID-19 response, as well as key staff working in the civil nuclear, chemicals, telecommunications (including but not limited to network operations, field engineering, call centre staff, IT and data infrastructure, 999 and 111 critical services), postal services and delivery, payments providers and waste disposal sectors.
The latest guidance from BEIS for those in industry whose workers they consider 'critical' is to draft a letter confirming this as a form of self-certification. An employer needs to generate a “to whom it may concern” letter stating their employee falls under one of the COVID-19 definitions of a 'critical worker' and so therefore their children should be prioritised for school-based care. The employee then should take the letter to the school or relevant authority as quickly as possible. It is recommended that you include any details you can about your company and the nature of the critical work within the letter.
 
Please note also that those who can operate without certain workers onsite are strongly advised to do so – the primary aim of the government guidance is to limit the spread of COVID-19, so please consider this when writing letters for your employees.
 
 
The BPF is continuing to liaise with BEIS to try to ensure that the plastics industry gets the support it needs, as it is of strategic importance to the UK.
 

Apprenticeships

24 March

The Education and Skills Funding Agency is taking steps to ensure that, wherever possible, apprentices can continue and complete their apprenticeship and to support providers during this challenging time. New guidance has been published for apprentices, employers, training providers and assessment organisations.

Workplace Canteens 

25 March

Where there are no practical alternatives, other workplace canteens can remain open to provide food for their staff and/or provide a space for breaks, the government has confirmed in further guidance

However, where possible, staff should be encouraged to bring their own food, and distributors should move to takeaway. Measures should be taken to minimise the number of people in the canteen at any one given time, for example by using a rota.

Self-isolation

20 March

The Department of Health and Social Care has published guidance for online isolation notes, to help those unable to work for more than seven days because of coronavirus.
 
The notes are for those whom have been advised to self-isolate – either for themselves, or for someone they live with – and cannot work.
 
1) First seven days – employees don’t need to give evidence to employers as they can self-certify
2) After seven days  - isolation note available if employer asks for evidence
3) Universal credit claimants do not need to produce a fit note/isolation note
 
The note can be accessed on the NHS website, or on NHS 111 online.

On 21 March, the government updated its advice for businesses delivering goods and services abroad that have been impacted by the coronavirus outbreak, including what financial support is available for businesses trading internationally.

The Department for International Trade can support businesses by providing assistance with customs authorities to ensure smooth clearance of their products; and offering advice on intellectual property and other issues with business continuity.

The European Commission has also issued practical advice (23 March) about how to implement its guidelines for border management in order to keep freight moving across the EU during the current pandemic. To ensure that EU-wide supply chains continue to operate, Member States are requested to designate, without delay, all the relevant internal border-crossing points on the trans-European transport network (TEN-T) as ‘green lane' border crossings. 

The green lane border crossings should be open to all freight vehicles, whatever goods they are carrying. Crossing the border, including any checks and health screening, should not take more than 15 minutes.

On 20 March, the government announced that MOTs for lorries, buses and trailers are suspended for three months from 21 March. In most cases, vehicles and trailers will be automatically issued a three-month exemption without any action required. However, you are advised to check which vehicle types require you to apply.

NEW - 05 November

Government extends Furlough to March and increases self-employed support

The Chancellor has announced that workers across the United Kingdom will benefit from increased support with a five-month extension of the furlough scheme into Spring 2021.  The Coronavirus Job Retention Scheme (CJRS) will now run until the end of March with employees receiving 80% of their current salary for hours not worked.  Similarly, support for millions more workers through the Self-Employment Income Support Scheme (SEISS) will be increased, with the third grant covering November to January calculated at 80% of average trading profits, up to a maximum of £7,500.

Loan schemes: application deadlines extended to 31 January 2021

The application deadlines for the coronavirus Bounce Back Loan, Coronavirus Business Interruption Loan, Coronavirus Large Business Interruption Loan Scheme and coronavirus Future Fund have been extended until 31 January 2021.

Measurement for Recovery – 20 days free consultancy

M4R is a new programme to support UK industry through access to specialist science and engineering advice and facilities at no charge. It is run by NPL and its partner National Measurement Laboratories who are committed to supporting the UK Government’s plans for economic recovery by providing specialist measurement advice and short-term projects to companies.  Applications can be submitted through the M4R portal on the NPL website.

Job Support Scheme expansion

The Chancellor has announced that the Job Support Scheme (JSS) will be expanded to support businesses across the UK required to close their premises due to coronavirus restrictions. 

 

Self-Employment Income Support Scheme grant extension

This grant is being extended from 1 November 2020 and guidance is available on how HMRC will work out trading profits and non-trading income if you're self-employed or a member of a partnership and have been adversely affected by coronavirus.  A video on how to claim the second grant step-by-step is also available.

 

Coronavirus Job Retention Scheme and Job Retention Bonus

30 November 2020 is the last day businesses can submit claims for periods ending on or before 31 October 2020 for the Coronavirus Job Retention Scheme.  Separately, further information has been published on how businesses can claim the government’s Job Retention Bonus including details on how to apply.

The National Cyber Security Centre’s re-launched Small Business Guide sets out five key areas for businesses to help improve their cyber security.  There is also guidance that helps small to medium sized organisations prepare their response to and plan their recovery from a cyber incident. 

 

Travel corridors in England

People arriving in England from the Greek Islands of Lesvos, Santorini, Serifos, Tinos and Zakynthos do now not need to self-isolate. The travel corridor list of countries and territories from where you can travel to England is available to view and regularly updated.

The government has announced that commercial tenants will be protected from the risk of eviction until the end of 2020 helping businesses to protect jobs.

Travel corridor update

The travel corridor list of countries and territories from where you can travel to England and may not have to self-isolate is available here to view. Countries and territories can be taken off or added to this travel corridor list at any time.

  • Singapore and Thailand have now been added to the travel corridor list.  
  • French Polynesia, Hungary, Reunion and mainland Portugal (not including Madeira and the Azores), Guadeloupe and Slovenia have been removed from the travel corridor list.

UK firms voluntarily return £215m in furlough cash

UK firms have voluntarily returned more than £215m to the government in furlough scheme payments they did not need or took in error.  According to HMRC figures, some 80,433 employers have returned cash they were given to help cover workers' salaries.

Nearly a million workers used flexible furlough in July

Nearly a million workers returned to their jobs part-time in the first month flexible furlough was introduced.  Flexible furlough began on the 1st July - giving businesses the flexibility to bring employees back part-time, with the government paying 80% of their wages for the hours not worked.

Companies House to resume the compulsory strike off process

From 10 October 2020, Companies House will resume the process to strike off companies they believe are no longer carrying on business or in operation. Overtime and the Coronavirus Job Retention Scheme

Guidance on calculating how much you can claim using the Coronavirus Job Retention Scheme has been updated with a new section on how to calculate your claim for fixed pay employees who have worked enough overtime (in the tax year 2019 to 2020) to have a significant impact on the amount you need to claim.

Countries removed from travel corridor list

France, the Netherlands, Monaco, Malta, Turks and Caicos Islands and Aruba to be removed from the exempt list for arrivals from 4am Saturday 15 August 2020. If you arrive in England from the above countries or territories before 4am 15 August you may not need to self-isolate. Read the rules about when you need to self-isolate and for how long.

Calling all tradespeople

The £2 billion Green Homes Grant will part fund improvements of over 600,000 homes, supporting over 100,000 jobs in green construction. The scheme will cover green home improvements that could help families save up to £600 a year on their energy bills.

BPF member Baerlocher were recently visited by Rochdale Council who were very impressed with all the measures the company has put in place to ensure the site is as Covid secure as possible. Measures Baerlocher have put in place include a one-way system, clear signage, designated walkways, readily available hands sanitiser and temperature cameras.

New guidance for businesses and organisations on how to recognise, contain and report incidents of coronavirus has been published. Covid-19 early outbreak management information has been created to make sure that people who run businesses or organisations know how to recognise and report an incident of coronavirus and are aware of measures local health protection teams may advise in order to contain it.

The government has introduced a new law to ensure furloughed employees receive statutory redundancy pay based on their normal wages, rather than a reduced furlough rate.

£20 million in new grants for small businesses

Plan for Jobs

Delivering his Summer Economic Update in Parliament, the Chancellor announced a package of measures – Plan for Jobs - to support jobs in every part of the country.  The package includes businesses being given £2,000 for each new apprentice they hire under the age of 25, a £111 million investment to triple the scale of traineeships in 2020-21 and £17 million of funding to triple the number of sector-based work academy placements in 2020-21.

As part of the Chancellor’s newly announced ‘Plan for Jobs’, a Job Retention Bonus will be introduced to help firms keep furloughed workers. UK Employers will receive a one-off bonus of £1,000 for each furloughed employee who is still employed as of 31 January 2021.

Claiming for employees furloughed on or before 30 June

HMRC have confirmed that employers need to claim by 31 July for employees furloughed through the Coronavirus Job Retention Scheme (CJRS) for periods ending on or before 30 June.  Furthermore, employers will no longer be able to use a CJRS grant to cover National Insurance (NI) and pension contributions for furloughed employees from 1 August.

More firms can now benefit from the Future Fund

The government has announced that more start-ups and innovative firms will now be able to apply for investment from the government’s Future Fund.  To date, more than 320 companies have benefitted from £320 million of Future Fund support.

Government launches Sustainable Innovation Fund

The government have announced a Sustainable Innovation Fund for companies who need urgent financial support to keep their cutting-edge projects and ideas alive.  Funding totalling almost £200 million could go towards developing new technologies such as apps encouraging people to cut down their food waste or sustainable biodegradable packaging.

Mandatory MOT testing to be reintroduced from 1 August

Due to the coronavirus outbreak, drivers were granted a 6-month exemption from MOT testing in March. However, as restrictions are eased, all drivers whose car, motorcycle or van is due for an MOT test from 1 August will be required to get a test certificate to continue driving their vehicle.

Exporting PPE – updated guidance

Government guidance has been updated and businesses no longer need to apply for an export licence to export personal protective equipment.

UK economy hit by worst contraction in 41 years

The UK economy shrank more than first thought between January and March, contracting 2.2% in the joint largest fall since 1979, official figures show.  The Office for National Statistics (ONS) revised down its previous estimate of a 2% contraction, with all the main economic sectors dropping.

Government COVID-19 business guidance

The government has updated their guidance for businesses, including guidance for factories, warehouses, offices and construction workers, on how business can reduce the risk of Covid-19 transmission by

taking certain steps to protect workers and customers.  These include (as outlined by the Prime Minister in Parliament yesterday), avoiding face-to-face seating by changing office layouts, reducing the number of people in enclosed spaces, improving ventilation, using protective screens and face coverings, closing non-essential social spaces, providing hand sanitiser and changing shift patterns so that staff work in set teams.

Measures to assist the construction industry

The government have published further details of the measures they are introducing this week to help the construction industry.  Planning permission deadlines will be extended, planning appeals will be sped up and builders will be allowed more flexible working hours following agreement with their local council.

In yesterday’s daily press conference, the Business Secretary announced: “Any business must complete a COVID-19 risk assessment” and it must also demonstrate that it is compliant to customers and businesses or  face harsh penalties. Although the Health and Safety Executive have stated they will not enforce this policy (of businesses publishing RAs on their websites), members are reminded of BPF’s Covid-19 H&S Hub, which includes the third edition of our Covid-10 Guidance on Good Manufacturing Practice. The third edition contains an HSE developed C-19 risk assessment template and notes on the government policy on risk assessments.

New ONS figures suggest more than 600,000 workers have lost jobs

Experimental data from the Office for National Statistics (ONS) and HM Revenue and Customs (HMRC) show that the number of paid employees fell by 1.7% compared with May 2019, and by 2.1% when compared with March 2020.  The ONS estimates that 163,000 people were no longer on payroll in May, on top of 449,000 in April — suggesting that 612,000 more people are now out of work compared to when lockdown began.

Drivers’ Hours Rules – Ends 14 June 2020

Due to the exceptional circumstances stemming from the COVID-19 outbreak and the unprecedented pressures on local and national supply chains, the Department authorised a general temporary relaxation of the enforcement of the GB domestic drivers’ hours rules, for drivers undertaking carriage of goods by road in England; Scotland and Wales, from 23 March 2020 to 14 June 2020. Following a recent review of the current evidence the Department has decided not to extend the relaxation of the GB drivers’ hours rules; which will end at 23:59 on Sunday 14 June 2020. The earlier relaxation of the EU drivers’ hours rules ended on 31 May 2020.

Coronavirus Job Retention Scheme (CJRS): Reminder – 10 June Deadline

The CJRS will close to anyone who hasn’t been furloughed for 3 weeks by 30 June, with the last three-week furloughs before that point commencing on 10 June. So you will only be able to claim for employees after that if they have been furloughed for a full three-week period at any time before the end of June. The rules of the scheme are changing from 1 July and on 12 June, the government will publish full guidance on all the scheme changes.

Economic impact of coronavirus on EU trade

The European Commission has published a second report on the estimated impact of COVID-19 on trade. According to the publication, the EU-27 might see a reduction of imports between 11% and 14%, and a reduction in exports of 9% to 15%.

UK 14 day quarantine policy

The Home Secretary has announced further details of the 14 day borders quarantine policy. Further to the confirmation of an exemption for hauliers and specialist workers, the government have made available a template letter and accompanying guidance to be issued for staff eligible for an exemption.  Annexe B in the guidance document includes the full details of the exemption for hauliers and specialist workers.

Trade Credit Insurance backed by £10 billion guarantee

The government is to provide guarantees of up to £10 billion to Trade Credit Insurance schemes for business-to-business transactions.

Furlough clarification on eligibility

BEIS have clarified the eligibility on furlough, noting that “claims from July onwards will be restricted to employers currently using the scheme and previously furloughed employee”. This means all employers who have previously furloughed staff. Employers will not be eligible from July if they have not previously furloughed their staff, but will be eligible if they have furloughed them previously at any point. The individuals do not have to be on furlough on 30 June / on the day of the announcement to be eligible to be furloughed from 1 July, as long as they have been furloughed previously. The latest date an employer can place their staff on furlough for the first time is 10 June.

Chancellor extends Self-Employment Support Scheme

The Chancellor has confirmed the extension of the Self-Employment Income Support Scheme. Those eligible will be able to claim a second and final grant in August. The grant will be worth 70 percent of their average monthly trading profits, paid out in a single instalment covering three months’ worth of profits, and capped at £6,570 in total.

Government confirms furlough next steps

The government has announced that from 1 July 2020, businesses will be given the flexibility to bring furloughed employees back to work part time. This is a month earlier than previously announced to help support people back to work. Individual firms will decide the hours and shift patterns their employees will work on their return, so that they can decide on the best approach for them - and will be responsible for paying their wages while in work.

Guidance on the coronavirus and data protection

The Information Commissioner has produced guidance on workplace testing for COVID-19 and the associated data protection issues, including whether an employer can share positive test results with other members of staff. Coronavirus Future Fund now open for applications

The Future Fund will provide government loans to UK-based companies ranging from £125,000 to £5 million to innovative companies which are facing financing difficulties due to the coronavirus outbreak, subject to at least equal match funding from private investors.  These convertible loans may be a suitable option for businesses that typically rely on equity investment and are unable to access other government business support programmes because they are either pre-revenue or pre-profit.

COVID-19 Statutory Sick Pay Rebate Scheme

This scheme will allow small and medium sized employers, with fewer than 250 employees, to apply to HMRC to recover the costs of paying Statutory Sick Pay to their employees. HMRC has published online guidance which includes information about who can use the scheme and the records employers must keep. Details about when the new Statutory Sick Pay Rebate Scheme can be accessed and when employers can make a claim will be announced in the coming weeks.

New government guidance for apprenticeships

14 May

The Department for Education has issued new guidance regarding temporary flexibilities to the apprenticeship programme during the pandemic.  These changes include:

  • Confirming flexibilities to allow furloughed apprentices to continue their training and to take their end-point assessment, and that existing furloughed employees can start a new apprenticeship (as long as it does not provide service to, or generate revenue, for their employer.)
  • Encouraging training providers to deliver training to apprentices remotely and via e-learning as far as is practicable.
  • Allowing the modification of end-point assessment arrangements, including remote assessments wherever practicable and possible.
  • Clarifying that apprentices ready for assessment, but who cannot be assessed due to COVID-19 issues, can have their EPA rescheduled.
  • Enabling employers and training providers to report and initiate a break in learning, where the interruption to learning due to COVID-19 is greater than 4 weeks and including clarification on how to record breaks that occurred in March.
  • Confirmation that there will be support for apprentices who are made redundant to find alternative employment, or if ready to go through gateway, will support with assessment arrangements.

BPF calls for more government support for exporters – Exporters Survey Report

13 May

The BPF are calling on the government to increase the level of financial support for companies in the plastics supply chain involved in export. Philip K. Law (Director General) met with the International Trade Select Committee, whilst prior to this the BPF had conducted a survey of companies within its membership that export. 76% of the companies that responded stated that export sales equated for at least half of their turnover, noting also that over the next 12 months, 75% of respondents expected an overall decrease in export sales. Working safely during COVID-19

On Monday the government released its ‘Working safely during coronavirus (COVID-19)’ guidance to help ensure workplaces are as safe as possible. Included in the guidance is an objective that all employers carry out a COVID-19 risk assessment – which they advise you should share the results of with employees. BEIS has provided a notice which businesses can display in the workplace to show you have followed this guidance, available here. Coronavirus Job Retention Scheme

11 May

In response to feedback from customers using the service, HMRC have added a 'save and return' option. This means that you can now return to a partially completed claim, rather than having to do it all in one go. HMRC have also confirmed that when employers make a claim through the Coronavirus Job Retention Scheme, they will receive the funds within six working days after application provided claim matches records that we hold for PAYE.

Self-Employment Income Support Scheme

HMRC have started contacting individuals who may be eligible for the new Self-Employment Income Support Schemethis online checker allows you to see if you are eligible. The scheme will allow those eligible to claim a taxable grant worth 80% of their average trading profits up to a maximum of £7,500, equivalent to three months’ profits. All payments will be made by 25 May.

The government have updated some of their guidance for the Job Retention Scheme

  • Employee guidance:
    • Furloughed employees who are union or non-union representatives may undertake duties and activities for the purpose of individual or collective representation of employees or other workers.
    • Company Directors paid annually are eligible to claim.  
    • Employees receiving Maternity Allowance during a period of Maternity Leave should not receive furlough pay at the same time.
  • Employer guidance: eligibility
    • CJRS grants are not classed as state aid.
    • Changed the date from 28 February to 19 March 2020 in the section on TUPE transfers and payroll consolidation.
  • Employer guidance: how to calculate the grant
  • Added the June daily maximum wage rates to the table now the scheme has been extended.
  • Improved clarity in the employer National Insurance contributions section, confirmed the direct percentage method or tables method can be used and added new information for company directors.

Defra delays ban on plastic straws, stirrers and cotton buds

Defra has delayed by six months the introduction of a ban on plastic straws, stirrers and cotton buds due to the “huge challenges posed to businesses and local authorities by COVID-19″. 

European Commission food safety Q&A

16 April

The European Commission has prepared a Q&A on food safety during the coronavirus. Section 1.3 covers food packaging and states: “…there is no evidence that contaminated packages, which have been exposed to different environmental conditions and temperatures, transmit the infection. Nonetheless, to address concerns that virus present on the skin might be able to transfer to the respiratory system […] persons handling packaging, including consumers, should adhere to the guidance of public health authorities regarding good hygiene practices, including regular and effective hand-washing.”

HSE guidance on report COVID-19 cases

14 April

The Health and Safety Executive has stated that companies must only make a report under RIDDOR (The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013) when:

  • An unintended incident at work has led to someone’s possible or actual exposure to coronavirus. This must be reported as a dangerous occurrence.
  • A worker has been diagnosed as having COVID 19 and there is reasonable evidence that it was caused by exposure at work. This must be reported as a case of disease.
  • A worker dies as a result of occupational exposure to coronavirus.

Personal protective equipment (PPE): export control process

During the coronavirus (COVID-19) outbreak, anyone wishing to export personal protective equipment (PPE) to areas outside the EU, European Free Trade Association member states and certain other territories will temporarily need a PPE export licence. The guidance has been updated with a link to a question and answer document by the EU.

Local advice and support for Business

Growth hubs are local public/private sector partnerships backed by the government, led and governed by Local Enterprise Partnerships (LEPs). The network of 38 Growth Hubs across England provide a free to use, impartial and local single point of contact to all businesses. The hubs can advise businesses on local and national business support - including schemes put in place to help businesses through the current Covid 19 situation - and help businesses build their resilience. Businesses can find their local Growth Hub here.

Call for rapid sanitising technology

02 April

The Defence and Security Accelerator (DASA) has announced that it is looking for rapid sanitising technology to speed up the time it takes to clean ambulances. It can currenting take up to 45 minutes to clean ambulances once they have transported a patient suspected of having COVID-19. Solutions must be suitable for rapid deployment to clean public sector vehicles – and possible even hospital wards – that have been exposed to patients with COVID-19.

In response, DASA launched a new Innovation Focus Area as part of its Open Call for Innovation seeking industry’s help to identify rapid sanitising technology solutions.

Ministry of Defence contacts employers of reservists

The Ministry of Defence has contacted employers to advise them that they are calling up 3,000 military reservists as part of the UK’s response to the coronavirus crisis. They will be used in a range of roles, such as providing medical and logistical support for the NHS, acting as liaison officers and deploying specialist skills such as engineering and accounting.

Information regarding insurance for home workers

Many people working from home are unlikely to have home insurance policies that cover the premises being used as a place of work. An official response from the Association of British Insurers includes a pledge to support both home workers and key workers, and states that existing policies do not need to be updated.

Coronavirus Job Retention Scheme (section already exists)

The government has provided new guidance for employers on the Job Retention Scheme
  • The Job Retention Scheme is a temporary measure, due to be up and running by the end of April.
  • Employers can use a portal to claim for 80% of employees on a leave of absence’s usual monthly wage costs, up to £2,500 a month.
  • The government will also cover the employer national insurance and minimum auto-enrollment pension scheme contributions.
  • The scheme is open to all UK employers that had created and started a PAYE payroll scheme on 28 February 2020.

Updated guidance for Small Business Grants Fund

The Department for Business, Energy and Industrial Strategy (BEIS) today published updated guidance for local authorities on business support grant funding, which includes details and eligibility criteria for the Small Business Grants Fund (SBGF).  The updated guidance covers state aid, monitoring and reporting requirements, new annexes on state aid, Spotlight, and post payment checks.

Temporary changes to Right to Work checks

Since 30 March 2020, Right to Work checks have been temporarily adjusted to make it easier for employers to carry them out during the coronavirus outbreak. Until further notice, employers do not need to see original documents and can complete Right to Work checks over video calls.

Changes to insolvency law

The Business Secretary has announced that new measures will be introduced to improve the insolvency system, which provides the legal options for companies running into major difficulties. Further details will be provided in the coming days.

Competition and Markets Authority publishes its approach to business cooperation

The CMA has published reassurance that provided coordination between competing businesses is undertaken solely to address concerns arising from the current crisis it will not take action.

Call for increase in National Living Wage to be delayed

The Resolution Foundation, a leading think tank, has called for the upcoming increase in the National Living Wage to be delayed by six months to help firms in low-paying sectors.

Working Time Directive

27 March

A number of BPF members have asked about the suspension of the Working Time Directive to allow longer hours. The BPF has been told that existing exemptions within the Working Time Regulations 1998 already provide flexibility. 

Regulation 21(e) covers where a worker’s activities are affected by unusual and unforeseeable circumstances beyond the employer’s control, or exceptional events, the consequences of which could not have been avoided despite the exercise of all due care by the employer.

Where this applies, the requirements around rest breaks, daily and weekly rest and night work do not apply.  However, the employer must provide compensatory rest, or if this is not possible to take other measures to ensure a safe working environment.

It is important that employers can demonstrate there are “other measures to ensure a safe working environment” in these circumstances.

Bank of England Summary of Business Conditions Q1 2020

27 March

The Bank of England summary of business conditions for Q1 2020 highlights that the Covid-19 pandemic has caused a sudden, rapid decline in economic activity in recent weeks. The Bank adds that the situation has been described by many agency contacts as being worse than the financial crisis in 2008.

Coronavirus Business Interruption Loan Scheme

26 March

The British Business Bank has published a useful guide explaining the key features of the scheme.

25 March

On 23 March, the government released guidance on how to access the new Coronavirus Business Interruption Loan Scheme and Covid Corporate Financing Facility. The scheme is now available for applications. This scheme will help any viable business with a turnover of up to £45m to access government-backed finance of up to £5 million

The Bank of England’s new lending facility for larger firms – the Covid Corporate Financing Facility – is also open to applications. The scheme is open to firms that can demonstrate that they were in sound financial health prior to the impact of coronavirus.

The FCA has issued new guidance to firms participating in the Government's Coronavirus Business Interruption Loan Scheme, which supports lending to small and medium-sized enterprises (SMEs) impacted by coronavirus of up to £5 million. However, loans of up to £25,000 to sole traders and unincorporated enterprises can fall within the scope of FCA regulation.

The FCA has issued guidance on the information and circumstances that are relevant when assessing the affordability of such loans. The fact that the customer may, at the time of the application, be temporarily experiencing exceptional financial pressures does not mean that the firm is prevented from making the loan.
 
The guidance says that:
  1. Lenders may take into account appropriate evidence, including historic trading figures as well as future forecasts.
  2. If forecast income does not materialise, lenders should consider deferring repayments until it does. 
 
19 March
  • A new temporary Coronavirus Business Interruption Loan Scheme, delivered by the British Business Bank, will launch next week to support businesses to access bank lending and overdrafts.
  • This will help ensure that eligible businesses facing short-term cash flow difficulties can continue to access finance as they respond to the temporary impact of the coronavirus outbreak on cash flow.
  • By providing an 80% government guarantee on eligible lending, this scheme will give lenders the confidence to keep lending to businesses. The government will provide as much capacity as required for this scheme. There will be no fee for lenders or borrowers to benefit from this guarantee.
  • The Scheme will support loans of up to £5 million in value. Businesses can access the first 6 months of that finance interest free, as government will cover the first 6 months of interest payments.
  • The scheme is open to businesses with a turnover of less than £41m (as long as the business is long-term viable and is UK based) which meet the scheme’s eligibility criteria. Full details on the eligibility criteria will be announced shortly.
  • The first loans will be available next week and further details of the new scheme will be announced shortly. Businesses worried about accessing finance now should speak to their usual lender.

Coronavirus Job Retention Scheme

23 March

Under the Coronavirus Job Retention Scheme, all UK employers will be able to access support to continue paying part of their employees’ salary for those employees that would otherwise have been laid off during this crisis. All UK businesses are eligible.

HMRC will reimburse 80% of furloughed workers wage costs, up to a cap of £2,500 per month. HMRC is working urgently to set up a system for reimbursement, as existing systems are not set up to facilitate payments to employers.

Small Business Grant Scheme

19 March

  • The government will provide additional funding for local authorities to support small businesses that already pay little or no business rates.
  • This funding will provide a one-off grant of £10,000 to businesses currently eligible for small business rate relief (SBBR) or rural rate relief.
  • If your business is eligible for SBRR or rural rate relief, you will be contacted by your Local Authority – you do not need to apply.
  • The Business Secretary will write to all Local Authorities by the end of the week with information on this scheme, and to encourage them to prepare to deliver this quickly.

Financial Assistance Scheme for Statutory Redundancy Payments

24 March

Information has been published about the financial assistance scheme for employers unable to pay statutory redundancy payments. If you cannot afford to pay your employees redundancy pay you can apply to the Redundancy Payments Service (RPS) for financial assistance.

Covid Corporate Financing Facility

24 March

Under the new COVID-19 Corporate Financing Facility, the Bank of England will buy short term debt from larger companies. All non-financial companies that meet the criteria set out on the Bank of England’s website are eligible. The scheme is now available for applications. 

Eviction Protection for Commercial Tenants

24 March

Commercial tenants who cannot pay their rent because of coronavirus will be protected from eviction, the government has announced. These measures, included in the emergency Coronavirus Bill currently going through Parliament, will mean no business will be forced out of their premises if they miss a payment in the next three months.

Call for Evidence

20 March

The Treasury Select Committee has issued a call for evidence on government's coronavirus financial package. The committee is planning to continue holding evidence sessions on the economic impact of coronavirus. It has asked for this initial tranche of evidence to be submitted by 5pm on Monday 23 March 2020.

The Bank of England has also cancelled this year’s stress-testing exercise and given firms additional supervisory guidance for how they should handle the effects of the coronavirus outbreak with regards to the forecasts as part o their IFRS9 reporting.

  • The main route for government support of SMEs, especially in sectors such as manufacturing where there is not industry-specific support, is through the British Business Bank, and particularly the new Coronavirus Business Interruption Loan Scheme
  • In the case of large firms, their banks will be able to talk to the Bank of England.
  • Local authority rates will be an issue for local authorities and details are in development.

Gender Pay Gap Reporting

 25 March

On 24 March, the government announced the suspension of enforcement of the gender pay gap reporting deadlines for this year (2019/2020). This means means that employers will no longer be expected to report on this data until further notice.

Preliminary Financial Statements 

25 March

The Financial Conduct Authority (FCA) announced a freeze on the publication of preliminary financial statements for at least two weeks. The FCA, FRC and the PRA will shortly be announcing further measures to prepare appropriate disclosures and address practical challenges.

 
23 March
The government has announced it will support businesses by deferring Valued Added Tax (VAT) payments for three months. For VAT, the deferral will apply from 20 March 2020 until 30 June 2020. All UK businesses are eligible.

This is an automatic offer with no applications required. Businesses will not need to make a VAT payment during this period. Taxpayers will be given until the end of the 2020 to 2021 tax year to pay any liabilities that have accumulated during the deferral period. VAT refunds and reclaims will be paid by the government as normal.

HMRC has also scaled up their Time to Pay offer to all firms and individuals who are in temporary financial distress as a result of Covid-19 and have outstanding tax liabilities.

Statutory Sick Pay

The Government will be given the ability to temporarily suspend laws which means Statutory Sick Pay (SSP) is not paid for the first three days of an absence, with a plan to retrospectively allow SSP to be given to workers affected since 13 March. As announced by Chancellor Rishi Sunak in his Budget, the legislation will allow firms with fewer than 250 employees to reclaim the cost of SSP given to workers as a result of the coronavirus outbreak.

CMA launched a taskforce on 20 March, prompted by many concerns that businesses might exploit the situation to take advantage of people, for example by charging excessive prices or making misleading claims about their products.  
 
As well as helping to advise the government on emergency legislation and competition law, the taskforce will: 
  1.  Scrutinise market developments to identify harmful sales and pricing practices as they emerge.
  2. Warn firms suspected of exploiting these exceptional circumstances – and people’s vulnerability – through unjustifiable prices or misleading claims. The CMA has already contacted traders and platforms regarding excessive pricing of hand sanitiser.
  3. Take enforcement action if there is evidence that firms may have breached competition or consumer protection law and they fail to respond to warnings.

The Small Business Minister and Small Business Commissioner also called on the UK’s big businesses to speed up payments to their small business suppliers wherever they can to ease COVID-19 related cash flow issues. You can find more information here.

Reducing the Spread: Advice for Manufacturers

 

Cleaning routines, change over times, staff interactions, visitors and vulnerable workers - view the British Plastics Federation's latest advice to UK plastic companies to help minimise the risk of spreading the coronavirus.

Employers who have people in their offices or onsite are reminded they should ensure employees are able to follow Public Health England guidelines including, where possible, maintaining a two metre distance from others, and washing their hands with soap and water often for at least 20 seconds (or using hand sanitiser gel if soap and water is not available).

Working from Home: Advice for Employers

There has also been more government guidance on working from home published. Employers and employees should discuss their working arrangements, and employers should take every possible step to facilitate their employees working from home, including providing suitable IT and equipment to enable remote working.

Sometimes this will not be possible, as not everyone can work from home. Certain jobs require people to travel to their place of work – for instance if they operate machinery, work in construction or manufacturing, or are delivering front line services.

Economic impact on the Plastics Industry

The British Plastics Federation (BPF) ran a flash survey of its members and published the results on 20 March 2020. With 127 BPF members responding in just a few hours, the results provide an accurate picture of the impact of the coronavirus on UK’s third largest manufacturing sector at this unprecedented time.
